Export Controls and Sanctions Policy
Requirements for lawful access, transfer, and use of KiTech Software products and services across jurisdictions.
1. Scope
This policy applies to the access, download, use, transfer, export, re-export, provision, and distribution of KiTech Software products, services, source code, technical information, and related support.
It supplements the Terms of Service, product-specific terms, open-source licences, and applicable law.
2. Compliance requirement
You must not use, export, re-export, transfer, release, provide, or make available a KiTech product or service in breach of applicable export-control, trade-sanctions, import, customs, or anti-boycott laws.
This includes restrictions that apply based on:
- the destination country or territory;
- the identity, ownership, or control of a person or organisation;
- the intended end user;
- the intended end use;
- the product, technology, encryption, or technical information involved; and
- the origin of components, software, or services used in a transaction.
3. Prohibited uses
You must not knowingly use or provide a KiTech product or service:
- to a person or entity subject to an applicable asset freeze, blocking measure, or equivalent prohibition;
- in a comprehensively sanctioned destination where the activity is prohibited;
- for prohibited military, weapons, surveillance, nuclear, chemical, biological, missile, terrorism, or human-rights-abusive end uses;
- to evade, conceal, facilitate, or circumvent export controls or sanctions; or
- through false, incomplete, misleading, or unauthorised identity, destination, ownership, or end-use information.
4. User representations
By accessing a service where these controls apply, you represent that:
- you are not prohibited from receiving the service under applicable law;
- you will not provide access to a prohibited person or destination;
- information you provide about location, ownership, identity, and intended use is accurate; and
- you will obtain any licence, authorisation, or approval required for your use or transfer.
5. KiTech controls
Where reasonably necessary, KiTech may:
- request information about identity, ownership, location, destination, end user, or end use;
- restrict sign-up, access, downloads, support, payments, or transfers;
- screen relevant parties against applicable restrictions;
- suspend or terminate a transaction or service;
- preserve records required for compliance; and
- make disclosures to authorities where lawfully required.
A restriction may apply even where access is technically possible.
6. Open-source software
Public availability under an open-source licence does not remove export-control or sanctions obligations. Users remain responsible for determining whether their access, distribution, modification, transfer, or use is lawful.
7. Customer-managed and self-hosted deployments
Operators of customer-managed and self-hosted deployments are responsible for the jurisdictions, users, infrastructure, integrations, transfers, and end uses they permit. KiTech does not assume the operator’s export or sanctions compliance obligations unless a written agreement expressly states otherwise.
